When Does Plastic Waste Stop Being Waste? EU Industry Groups Want Answers

The Core Issue

European chemical industry group Cefic is pushing the EU to urgently create harmonised standards for determining when recycled plastics processed through chemical recycling stop being classified as “waste.” While the EU’s circular economy rules continue to develop, Cefic argues a significant gap remains: there’s no dedicated regulatory framework for chemical recycling specifically. The Commission’s Draft Implementation Act currently sets EU-wide “end-of-waste” criteria for plastics recycled mechanically or through solvent-based methods, but chemical recycling outputs are left out entirely.

What “End-of-Waste” Means and Why It Matters

End-of-waste criteria determine the point at which plastic waste legally transitions back into a usable raw material. The European Commission’s goal in clarifying these thresholds is to boost the supply of high-quality recycled materials, increase demand for secondary and circular products, and ultimately lower the cost of feedstock for manufacturers. Cefic contends that without harmonised criteria covering chemical recycling, the EU can’t fully unlock circular plastics across all recycling pathways.

Why Chemical Recycling Is Different

Cefic emphasizes that mechanical, solvent-based, and chemical recycling are complementary but structurally distinct—differing in the technologies used, their value chains, and the materials they produce. Chemical recycling breaks down the chemical structure of polymers, converting plastic waste into controlled secondary raw materials like oils, waxes, gases, oligomers, and monomers. This method is built to handle waste streams that mechanical recycling can’t process effectively, such as mixed plastic fractions, degraded polymers, thermoset materials, mechanical recycling residues, and composite or multilayer plastics—particularly useful for producing higher-quality materials needed for things like contact-sensitive packaging.

The Cost of Regulatory Fragmentation

Cefic warns that without unified EU standards, individual member states will keep applying inconsistent definitions of when waste stops being waste. This creates uncertainty for businesses operating across borders and discourages investment. The group frames this as a serious risk: a major recycling pathway could be left without the regulatory clarity it needs to expand.

Cefic’s Policy Recommendations

The group’s position paper urges the European Commission to:

  • Create harmonised, EU-wide end-of-waste criteria specifically for chemical recycling technologies to support the internal market and give investors certainty
  • Apply these criteria consistently and neutrally across all types of chemical recycling processes
  • Ensure that once materials officially exit “waste” status, they become subject to standard product and chemical regulations
  • Acknowledge that the end-of-waste point can occur at different stages depending on the specific recycling process
  • Adopt an approach focused on output and intended use, grounded in Article 6(1) of the Waste Framework Directive

Cefic stresses that without a dedicated framework, ongoing fragmentation will hinder innovation, disrupt cross-border supply chains, and delay investment in European chemical recycling infrastructure.

Plastics Europe’s Perspective

A related industry group, Plastics Europe, points to a different but connected issue: clarity is also needed under the Packaging and Packaging Waste Regulation (PPWR), which sets minimum recycled-content requirements for plastic packaging. The Commission is expected to define sustainability criteria for recycling technologies, weighing factors like economic and environmental performance, output quality, feedstock availability, and energy use. Plastics Europe cautions against criteria that would rank recycling technologies against each other, instead favoring straightforward eligibility conditions. It argues that mechanical, solvent-based, and chemical recycling each serve different roles, and using them together delivers the best overall environmental outcome—especially for greenhouse gas emissions—compared to alternatives like incineration for energy recovery.
